O.C. billionaire checks into rehab

henrynicholasblog.jpgHenry T. Nicholas III, the former chief executive of Broadcom Corp., checked into the Betty Ford Center for alcohol rehabilitation on Wednesday, voluntarily signing up for a 30-day admission, said Bill Hake, Nicholas’ personal attorney.

Hake said Nicholas, 48, a resident of Newport Beach, had been under stress following the death this month of his step father, Robert Warnes Leach, 93, and a ceremony at which his late sister, who was murdered in 1983, was re-interred at a memorial for crime victims.

Nicholas was also concerned about his drinking, Hake said, because he has a family history of alcoholism and because a laboratory test showed that Nicholas’ liver indicated signs of damage from too much alcohol.

Hake said the decision to seek treatment had nothing to do with allegations that Nicholas used drugs in a civil lawsuit by an ex-employee and a child custody dispute with his estranged wife, Stacey.

As part of the custody dispute, Hake said, Nicholas has submitted to 150 blood and 50 urine tests over the past 18 months to check for drugs and all of them came up negative.

Hake also said there was no connection to the possibility of federal civil or criminal charges that Nicholas could face for his role as CEO of Broadcom when the company backdated stock options for its employees to inflate the value of their compensation. In 2007, Broadcom issued a $2.2 billion non-cash restatement to reflect the true value of the options, the largest restatement by more than 150 companies accused of stock-option backdating.

“In this difficult time, Nick is seeing the value of life, weighed against the death of his father,” Hake said. “In that context, the investigation is trivial.”

    Nick, you have done a very brave and courageous thing especially given all of the current attention to everything you do right now. I can relate to your recent loss of your father. I lost my father a couple of years ago, to a very quick and aggressive form of cancer. Even those it’s been two years now, I still deal with his loss every day. He and I were vere close, as I know you were with Mr. Leach. Your father was a wonderful man and will be missed by many.

    You and your family are in my thoughts and prayers during this difficult time. I wish and hope only the best for you. This is the time when you discover who your real friends and closesth relatives are. Those who really care will be there for you when you need it most.

    Hang in there and know that many people are pulling for you and hoping you have a great recovery.

    Re SEC’s comment on backdating options being a federal crime, I have to ask: Is that actually true? Because the articles I’ve read all say that backdating options actually isn’t against the law, as long as the company accounts for them properly….

    Keep an open mind and use that powerful brain of yours to move away from the darkness and into the light and allow professionals to take you on a journey of healing and health. It can be done but you will need willingness and a desire to change that which negatively impacts your health, children, and life.
